Beginning in October, employers in Illinois may no longer ask job applicants, or applicants’ previous employers, the applicant’s salary history. The new law, signed by Gov. Pritzker on July 31, 2019, was enacted to help narrow the wage gap between men and women and achieve salary parity.
Violations are subject to damages of up to $10,000.
Employees are also permitted to discuss their salaries and benefits with co-workers.
Employers should review their job applications, interview questions, and hiring policies and procedures, as well as their reference procedures, to make sure they are in compliance.
